
On August 22, 2007, after one day and half trial, Charles I. Ellis, Jr. was found guilty of 16 of the 19-count indictment, which charged him with, engaging in the business of dealing in firearms, aiding and abetting the straw purchase of firearms and obstruction of justice.
On November 14, 2007, based on the “federal Sentencing Guidelines”, which due to his criminal history and several enhancements found Charles’s based level offense to be a 39, Charles was sentenced to 27 years imprisonment with 3 years of supervised probation upon his release, (the lower end of a possible 95 year sentence).
Charles went to the state of West Virginia in 1999 at age 19 to attend Ohio Valley Christian College.
On 2003, Charles was convicted of assault and battery, after a fight in a Hardy’s Restaurant in West Virginia and sentenced to 10 years in prison.
For the first time up for parole, Charles was found to have been rehabilitated and released in June 2005. As a condition of his parole, Charles had to remain on probation for 1 year in the State of West Virginia. In March 2006, Charles was arrested for the charges he stands convicted of today. These alleged crimes occurred between 1999 and 2002.
Charles spent over 1 and ½ years held without bail in the South Regional Jail in West Virginia. Charles was appointed several public defense counsels, none of which offered him any defense. All of his attorney’s believed that he was guilty as charged without making any further inquiry, obtaining discovery or any other material facts.
His family retained a private attorney in West Virginia for $10,000.00 and he too misled Charles into taking a plea agreement that would have landed him 30 years in prison without the possibility of an appeal.
Charles is 27 years old and is looking at spending the next 27 years of his life behind bars. There is no parole in the Federal System and Charles will have to serve 85% of his time before being considered for release.
In our plea for assistance we do not maintain that Charles is without fault for his choices made as a very young and naïve man. However, since that time Charles has grown and become a man committed to turning his life around. Having to spend his 20’s, 30’s, 40’s and the start of his 50’s behind bars for a crime he has been adjudged to have committed when he was only 19 years old is excessive. Charles has essentially been sentenced to a life sentence, one reserved for murders.
We are seeking justice in this case and we need your help. In the past, Charles has had to rely on the assistance of state employed attorney’s due to financial hardships. Appeals in the Federal system can be very costly. Thus far we have been quoted a fee upward of $50.000.00. Although, there are no guarantees that Charles will be successful in this process, justice requires that he be afforded the opportunity and receive a sentence equal to the crimes he committed.
